1. Scope and application

These Terms and Conditions apply to:

– Use of the website nextpositionadvisory.com

– Purchase of digital products, playbooks, and courses

– Purchase of strategic advisory services

– Participation in intake questionnaires and the Am I At Risk? assessment

– Enrolment in cohort programmes

– Receipt of advisory outputs, written summaries, and related materials

They form a legally binding agreement between you and Mayer Advisory GmbH.

2. Nature of services

Mayer Advisory GmbH provides:

– Strategic career advisory services for senior professionals

– Digital products and playbooks

– Diagnostic tools including the Am I At Risk? assessment

– Educational content related to organisational dynamics, career positioning, and professional decisions

– AI-supported structured intake questionnaires

– Written advisory outputs and call summaries from Lisa Mayer

All services are strategic and educational in nature.

They do not constitute:

– Financial, investment, or tax advice

– Legal advice

– Medical, mental health, or therapeutic services

– Coaching, counselling, or employment placement

– Guarantees of outcome, role changes, compensation, or employment

All decisions remain your sole responsibility. Strategic input reflects professional judgment based on experience and pattern recognition, not guarantees or predictions.

3. Digital products and playbooks

When you purchase a digital product, playbook, or the Am I At Risk? assessment:

Access

– Access or delivery is granted immediately or within 48 hours of purchase

– Access is personal and non-transferable

– You may not share, reproduce, or distribute materials with others

Licence

– You receive a limited, non-exclusive, non-transferable licence to access materials for personal use only

– Materials may not be shared, reproduced, distributed, or resold

– You may not use content for commercial purposes without written permission

4. Courses and cohort programmes

When you purchase Inside the Restructuring or enrol in a cohort programme:

Access

– Access is granted upon receipt of payment

– Access is personal and non-transferable

– You may not share login credentials or course materials with others

Licence

– You receive a limited, non-exclusive, non-transferable licence to access course materials for personal use only

– Materials may not be shared, reproduced, distributed, or resold

– You may not use course content for commercial purposes without written permission

Duration

– Course access (Inside the Restructuring): lifetime access upon purchase

– Cohort programme participation: limited to the programme dates as confirmed at enrolment

– Included calls and advisory elements are non-transferable to future cohorts

5. Strategic advisory service

5.1 Service structure

All strategic advisory services follow this process:

Step 1 – Payment: Payment must be completed before intake or preparation begins. Payments are processed securely via Stripe.

Step 2 – Intake: You complete a structured questionnaire or intake form as appropriate to the service purchased.

Step 3 – Advisory delivery: Lisa Mayer personally reviews the intake. Advisory is delivered in written form, live session, or both depending on the service.

5.2 Service tiers

Outside Read (CHF 150)

– Written advisory response to a specific situation or question

– Delivered within 48 hours of completed intake

– One-time engagement; capped availability

– CHF 150 credit toward a Decision Call if booked within 7 days

Decision Call (CHF 350)

– 45-minute live advisory session with Lisa Mayer

– Written summary delivered within 24 hours

– One-time engagement

– Fee credits toward advisory if booked within 7 days

Monthly Advisory (CHF 750/month)

– 60 minutes per month (single session)

– Async support capped at 3 check-ins per month with 48-hour response

– For steady-state situations; no minimum commitment

– Month-to-month; access continues for the paid period

Priority Advisory (from CHF 1,200)

– Active co-pilot mode for live or time-sensitive situations

– Unlimited same-day async support

– Priority scheduling

– Monthly written situation summary

– Scope and pricing confirmed at engagement; no minimum commitment

5.3 Service conditions

Strategic advisory services:

– Are based solely on the information you provide

– Reflect professional judgment, not factual verification

– Are limited to the scope purchased

We do not guarantee:

– Outcomes, results, or success

– Agreement with recommendations

– Career, financial, or reputational outcomes

6. Pricing and payment

All prices are displayed in CHF.

– Prices shown at time of purchase apply to that transaction

– We reserve the right to update prices at any time for future purchases

– Price changes do not affect purchases already completed

Payment processing

– All payments are processed securely via Stripe

– You must provide accurate billing information

– Payment is due in full at the time of purchase

– Payment links are shared via confirmation message; Calendly is not used for payment collection

6.1 Credit policy

– The Outside Read (CHF 150) credits toward a Decision Call if booked within 7 days of delivery

– The Decision Call fee credits toward advisory if an advisory engagement begins within 7 days of the call

– Credits are non-transferable and have no cash value

– Credits cannot be applied retroactively

6.2 Free tools

Free tools (including the Am I At Risk? assessment) are provided for informational purposes only. No guarantees are made regarding accuracy, applicability, or completeness. We reserve the right to modify or discontinue free tools at any time.

7. Refund policy

7.1 Digital products and playbooks

Due to the digital nature of our products, all sales are final. No refunds, exchanges, or cancellations are offered once access has been granted or materials have been delivered.

7.2 Courses and cohort programmes

– Inside the Restructuring: non-refundable once course access has been granted

– Cohort programme: non-refundable once the programme has commenced; cancellations prior to commencement at our discretion

7.3 Strategic advisory services

– Outside Read: non-refundable once the written response has been delivered

– Decision Call: non-refundable once the session has taken place or intake has been completed

– Monthly Advisory and Priority Advisory: non-refundable for the current paid period; you may choose not to renew

7.4 Exceptional circumstances

In exceptional circumstances (e.g., service not delivered due to our error, or technical failure preventing access), we may offer service re-delivery, credit toward future services, or a refund at our sole discretion. Dissatisfaction with recommendations or disagreement with strategic judgment is not grounds for refund.

8. Intake data and confidentiality

8.1 Information you provide

During the intake process, you will be asked to share professional background, career situation details, organisational dynamics, and personal constraints. This information is used solely to provide advisory services.

8.2 Confidentiality

We treat your intake data as confidential and will not:

– Share your personal information with third parties (except service providers necessary to deliver services – see Privacy Policy)

– Use your information for purposes other than providing services

– Disclose your identity in case studies or examples without your explicit written consent

Anonymised insights from client situations may be used for educational content, including LinkedIn posts and course materials, but all identifying information will be removed.

8.3 Data retention

Intake data is retained as described in our Privacy Policy (Section 6). You can request deletion of your intake data at any time, subject to legal retention requirements for payment records.

9. Intellectual property

All content on this website and provided through services, including text, images, course materials, templates, worksheets, advisory outputs, the NPA Strategic Decision Framework, and website design, is the intellectual property of Mayer Advisory GmbH unless otherwise stated.

Your permitted use

– Course and playbook materials: download and use for personal, non-commercial use only

– Advisory outputs: provided for your personal use; you may share with trusted advisors for personal guidance

– Website content: you may view and navigate for personal use

Prohibited actions

You may not:

– Copy, reproduce, or distribute any proprietary content

– Modify, create derivative works from, or reverse-engineer frameworks or materials

– Use content for commercial purposes without written permission

– Remove copyright or proprietary notices

– Share login credentials or access with others

Violation of intellectual property rights may result in immediate termination of access, legal action, and liability for damages.

10. AI-powered tools

AI tools are used within Next Position Advisory services to:

– Structure and organise intake information

– Generate the AI-powered Positioning Strategy Report in the cohort programme

– Deliver automated diagnostic outputs (Am I At Risk? assessment)

AI does not:

– Make decisions for you

– Provide personalised strategic advisory

– Replace human judgment

All strategic advisory judgment is provided by Lisa Mayer personally. AI outputs are reviewed and refined by Lisa before delivery where applicable.

11. Website use and availability

11.1 Availability

We aim to keep the website available and functional but do not guarantee uninterrupted access, error-free operation, or compatibility with all devices or browsers. We may update, modify, or remove website features at any time, and may perform maintenance that temporarily limits access.

11.2 Prohibited conduct

You may not:

– Use the website for unlawful purposes

– Attempt to hack, disrupt, or interfere with website functionality

– Upload malicious code or viruses

– Impersonate others or provide false information

– Harass, abuse, or harm others through the website

Violation may result in immediate termination of access and legal action.

13. Limitation of liability

Services and content are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or reliability, or guarantees of specific results or outcomes.

13.2 Limitation of damages

We are not liable for:

– Indirect, incidental, consequential, or punitive damages

– Loss of profits, revenue, or business opportunities

– Career outcomes, employment decisions, or financial results

– Decisions made based on advisory outputs or course content

– Damages arising from use or inability to use services

– Technical failures, data loss, or unauthorised access

Our total liability to you is limited to the amount you paid for the specific service or product giving rise to the claim.

13.3 Exceptions

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot be excluded under Swiss law.

14. Indemnification

You agree to indemnify and hold harmless Mayer Advisory GmbH, Next Position Advisory, and Lisa Mayer from claims arising from your use of services, violation of these Terms and Conditions, violation of any third-party rights, or decisions or actions taken based on services provided.

15. Changes to terms

We may update these Terms and Conditions from time to time to reflect changes in services or pricing, legal or regulatory requirements, or improvements to clarity. Updated Terms will be posted on this page with a new “Last Updated” date. Material changes will be communicated via email to active clients and a prominent notice on the website. Continued use of services after changes constitutes acceptance of updated Terms.

16. Termination

16.1 Your right to terminate

You may terminate services by cancelling recurring subscriptions, choosing not to renew after the current paid period ends, or requesting account deletion.

16.2 Our right to terminate

We may suspend or terminate your access if you violate these Terms and Conditions, engage in prohibited conduct, fail to resolve a payment failure, or if termination is required by law. Termination does not entitle you to refunds for services already delivered.

17. Data protection

Personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. By using our services, you consent to data processing as described in the Privacy Policy.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

19. Entire agreement

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and Mayer Advisory GmbH regarding use of services and supersede any prior agreements or understandings.

20. Governing law and jurisdiction

These Terms and Conditions are governed by Swiss law. Exclusive jurisdiction lies with the courts of Zürich, Switzerland, unless mandatory consumer protection laws provide otherwise.

If you are a consumer resident in the EU, you may also have rights under EU consumer protection regulations.
